These General Terms and Conditions (GTC) apply to all offers, services, productions, rentals and deliveries provided by brutal güet AG in the fields of broadcast, production and event technology. Deviations are only valid if agreed in writing. General terms and conditions of the customer are not accepted unless explicitly confirmed in writing.
Offers made by brutal güet AG are binding unless stated otherwise. A contract comes into effect through written acceptance or by using the offered service. Technical deviations or the replacement of equipment with equivalent alternatives may occur if they do not significantly affect the agreed service.
The scope of services is defined in the respective offer or individual agreement. Changes, additional work or extra efforts beyond the offer will be charged separately. brutal güet AG may subcontract parts of the work while remaining responsible towards the customer.
The customer ensures that all technical, organisational and safety-related requirements necessary for service
delivery are fulfilled, including:
• timely access to buildings, rooms and installations
• provision of required information, infrastructure and contact persons
• compliance with all safety regulations and legal requirements
Delays or additional costs resulting from insufficient preparation or incorrect information provided by the customer shall be borne by the customer. Additional or project-specific requirements are defined in the respective offers.
If brutal güet AG provides rental equipment, the following applies:
• All equipment remains property of brutal güet AG.
• Equipment must be used carefully and only as intended.
• Subleasing, resale or transfer to third parties is prohibited.
• Any defects must be reported immediately upon handover.
• Equipment must be returned complete, functional and clean.
• Delayed returns will incur additional rental costs.
The customer is fully liable for damage, loss or theft of rental equipment.
The prices stated in the offer apply. Additional charges may apply for:
• VAT
• extra work and additional services
• cleaning, repairs or replacement due to improper return of rental equipment
Payment terms are defined in the respective offer. In case of late payment, brutal güet AG may withhold services, charge reminder fees or terminate the contract.
In case of cancellation by the customer, the following fees apply:
• more than 30 days before service start: 25 % of the order volume
• 30 to 14 days before service start: 50 % of the order volume
• 13 to 7 days before service start: 75 % of the order volume
• less than 7 days or on the service day: 100 % of the order volume
Costs already incurred will be charged in full regardless of the cancellation date.
brutal güet AG is liable only for damages caused intentionally or by gross negligence. All further liability — especially for indirect damages, delays, interruptions, technical failures, data loss or lost profit — is excluded.
The customer is liable for:
• damage to rental equipment
• improper or unsafe operation
• missing safety measures
• theft, loss or environmental impacts
All concepts, plans, graphics, designs, audio/video files, layouts, programs and other intellectual works
created by brutal güet AG remain its property. Use outside the agreed project requires written approval.
Events beyond the control of brutal güet AG release it from liability. brutal güet AG may postpone or cancel
services if such events occur.
brutal güet AG treats all customer-related information confidentially and in accordance with legal regulations.
Swiss law applies exclusively. The place of jurisdiction is the registered office of brutal güet AG.
